Terms of Service

1. Acceptance of Terms

By accessing or using PINDEO ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms constitute a legally binding agreement between you and PINDEO. By creating an account, connecting a social media account, or otherwise using any part of the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms.

2. Account Registration

To use PINDEO, you must create an account. When registering, you agree to provide accurate, current, and complete information. You are responsible for maintaining the accuracy of this information and for updating it as needed.

You are solely responsible for safeguarding the credentials associated with your account. You must not share your account credentials with any third party. You are responsible for all activity that occurs under your account, whether or not you authorized that activity.

You must notify us immediately at support@pindeo.com if you become aware of any unauthorized use of your account or any other breach of security.

3. The Service

PINDEO is an AI-powered social media management platform designed for individual content creators. The Service provides six specialized AI agents that assist with social media strategy, content creation, publishing, analytics, trend monitoring, and engagement management.

The Service enables you to connect your social media accounts on supported platforms, including TikTok, Instagram, Facebook, X (Twitter), LinkedIn, YouTube, and Google Calendar. Through these connections, the AI agents can analyze your performance, draft content, schedule posts, monitor trends, and help you manage community engagement.

PINDEO acts as a tool to support your social media activities. It does not guarantee any specific outcomes such as follower growth, engagement rates, or revenue. Results depend on many factors outside our control, including platform algorithms, audience behavior, and content quality.

4. Content Ownership

Your content remains yours. You retain all ownership rights to any content you create, upload, or publish through PINDEO, including text, images, videos, and other media.

By using the Service, you grant PINDEO a limited, non-exclusive, revocable license to access, process, store, and analyze your content solely for the purpose of providing and improving the Service. This includes using your content to train your personal AI agents to better match your brand voice, style, and preferences. We do not use your content to train general AI models or share it with other users.

You represent and warrant that you have the necessary rights to any content you provide to the Service and that your content does not infringe on the intellectual property rights of any third party.

5. AI-Generated Content

PINDEO uses artificial intelligence, powered by large language models, to draft social media content including posts, captions, hashtags, and strategy recommendations. This AI-generated content is provided as a starting point and suggestion for your review.

You are solely responsible for reviewing, editing, and approving all AI-generated content before it is published to any social media platform. Nothing is published without your approval unless you have explicitly configured automated publishing in your account settings.

PINDEO does not guarantee that AI-generated content will be accurate, appropriate, free from errors, or suitable for your specific audience. AI outputs may occasionally contain inaccuracies, and you should verify any factual claims before publishing. You accept full responsibility for any content you choose to publish through the Service.

6. Social Media Platform Compliance

When you connect your social media accounts to PINDEO, you remain bound by the terms of service, community guidelines, and policies of each respective platform. PINDEO does not override or replace your obligations to those platforms.

You are responsible for ensuring that all content published through PINDEO complies with the rules of the platform on which it is posted. This includes, but is not limited to, content policies, advertising standards, rate limits, and API usage guidelines.

PINDEO is not responsible for any actions taken by social media platforms against your accounts, including suspension, restriction, or termination, whether or not those actions result from content published through the Service.

7. Acceptable Use

You agree not to use PINDEO to:

  • Generate or distribute spam, unsolicited messages, or bulk automated content designed to deceive or manipulate
  • Create, publish, or distribute content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
  • Engage in any activity that violates applicable laws or regulations, including data protection and privacy laws
  • Attempt to circumvent, disable, or interfere with the security, rate-limiting, or access-control features of the Service
  • Use the Service to impersonate another person or entity, or misrepresent your affiliation with any person or entity
  • Reverse engineer, decompile, or disassemble any part of the Service, or attempt to access the underlying source code
  • Use automated tools, bots, or scripts to access the Service outside of the provided interface and API, except as explicitly authorized

We reserve the right to suspend or terminate your account if we determine, in our sole discretion, that you have violated these acceptable use provisions.

8. Payment Terms

PINDEO offers a free tier and paid subscription plans. Paid plans include Creator ($29/month), Pro Creator ($59/month), and Business ($99/month). The features and limits associated with each plan are described on our pricing page and may be updated from time to time.

All payments are processed through Stripe. By subscribing to a paid plan, you authorize PINDEO to charge your designated payment method on a recurring monthly basis. Subscription fees are billed at the beginning of each billing cycle and are non-refundable except as described below.

You may cancel your subscription at any time through your account settings. Upon cancellation, you will retain access to your paid plan features until the end of your current billing period. After that, your account will revert to the free tier.

Refunds are handled on a case-by-case basis and are granted at our sole discretion. If you believe you are entitled to a refund, please contact us at support@pindeo.com.

We reserve the right to change our pricing at any time. If we change the price of your current plan, we will notify you at least 30 days in advance. Continued use of the Service after a price change takes effect constitutes your agreement to the new pricing.

9. Limitation of Liability

To the maximum extent permitted by applicable law, PINDEO and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or business opportunities, arising out of or related to your use of the Service.

PINDEO is not responsible for the performance of your social media accounts, including changes in follower counts, engagement metrics, reach, or any other outcomes. Social media platform algorithms, policies, and user behavior are outside our control.

AI-generated content is provided on an "as-is" basis. You acknowledge that AI outputs may contain errors, inaccuracies, or content that is unsuitable for your audience. It is your responsibility to review all content before publishing. PINDEO shall not be held liable for any consequences resulting from content you choose to publish.

In no event shall our total aggregate liability exceed the amount you paid to PINDEO in the twelve (12) months preceding the event giving rise to the claim.

10. Service Availability

We strive to provide reliable, uninterrupted access to PINDEO. However, we do not guarantee that the Service will be available at all times or without interruption. The Service may be temporarily unavailable due to scheduled maintenance, updates, or circumstances beyond our reasonable control.

We will make reasonable efforts to notify you in advance of any planned downtime. We are not liable for any loss or damage resulting from service interruptions, including missed publishing schedules or delayed analytics updates.

The availability and functionality of the Service may also be affected by changes to third-party platforms, APIs, or services that PINDEO integrates with. We will work to adapt to such changes, but we cannot guarantee uninterrupted compatibility with all third-party services at all times.

11. Termination

You may terminate your account at any time by contacting us at support@pindeo.com or through your account settings. Upon termination, your right to use the Service will cease immediately.

We may suspend or terminate your account at any time if you violate these Terms, engage in fraudulent or abusive behavior, or for any other reason at our sole discretion. We will make reasonable efforts to notify you before or at the time of termination, except where we believe immediate termination is necessary to protect the Service or other users.

Before or after termination, you may request an export of your data, including your content, analytics history, and account information. We will provide your data export within a reasonable timeframe. After termination, we may retain certain data as required by law or for legitimate business purposes, but we will delete your personal data in accordance with our Privacy Policy.

12. Changes to These Terms

We may update these Terms from time to time to reflect changes in our Service, legal requirements, or business practices. When we make material changes, we will notify you by email or through a notice within the Service at least 30 days before the changes take effect.

Your continued use of the Service after the updated Terms take effect constitutes your acceptance of the changes. If you do not agree with the updated Terms, you must stop using the Service and terminate your account.

We encourage you to review these Terms periodically. The date at the top of this page indicates when the Terms were last updated.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which PINDEO operates, without regard to conflict of law principles.

Any disputes arising out of or relating to these Terms or the Service shall be resolved through good-faith negotiation between the parties. If a resolution cannot be reached, the dispute shall be submitted to the exclusive jurisdiction of the courts in the applicable jurisdiction.
